When I worked for BMW of NA in Oxnard, CA we received all of the cars for the Western half of the USA. If a car happened to get damaged on the ship, in transit(before it hit the dealer) or at our facility and the cost of repair exceeded 3% of the vehicles MSRP it HAD to be sold as a used vehicle. I don't know if other manufacturers have to go by that rule but that's how it's done at BMW.
