Cool Dealing with warrenty company

Bought my car from a lady who bought an extended warranty that covers everything on the transmission except the clutch disc. When I test drove it had no issues. Shortly after first gear would pop out of gear. The warrenty company said take it in and we will get it fixed. The Chrysler dealer is recommending a complete rebuild or a remanufactured transmision. The service agent said that the warranty company wants to just replace a few parts, since it would not be their problem in a few days because it would be out of warranty. Any suggestions. I would like to make things right with out a lawyer if possible but it looks like its heading that way.

If this is an 04: The first gear pop out thing was a TSB issue. When the car was new, they would fix them under warranty - I have no clue why someone didn't just take the car in and let them fix it.

This comes up every once in a while.

It's a 05 and the transmission serial number is out side of the tsb. Butt it does the same thing as the earlier modles.
Thanks for the input though. I will know in a day or two if its going to get ugly.
