Cup holder won't Close

My cup holder won't latch...any way to fix without gluing the darn thing shut.
Is it covered by warranty?

Should be covered by warranty unless they can prove physical damage.

I wound up using industrial strength velcro. I had to put two small screws in the bottom and front edge of the top cover.
