Default BEGi Turbo Kit - I give (sorry)

Told Corky that I've had enough. Over 2.5 years ago he receive my car so he could mock up a turbo kit for us. After two weeks we still have nothing to show and I give.

Gave him till the end of August to return the car.

Hoping someone here can help legal wise when he doesn't return the car.
Suggestions? Comments?

I am now demanding the return of the car in operational condition and the payment no later than 30 days from the date of this email (31 August 2014).

If not returned I will involve law enforcement and other parties as necessary.
I am hoping that after over 2.5 years you will do the right thing.

I need to know what your intentions are.

I normally don't mind the pressure. The construction is almost done. I'll have it real close late next week.

I've put considerable labor into it since back to work. Sorry I'm a bit slower at the moment than usual. I don't expect that sits well with you.

The changes to a front turbo clearly have restored my enthusiasm for the car and turbo. However, It will put the kit out of range for most folks.

I'm back to driving a car as of this week. Not particularly comfortable.

You have been more patient than anyone else would be. I can't believe that the last photos they posted for your build was all the way back in September. If you go to /r/cars - For Car Enthusiasts you should be able to start a thread there and ask for advice. The forum is very helpful, they should at least be able to help point you in the right direction.

EDIT: Here's another link to help http://www.reddit.com/r/legaladvice . I think you should get a lawyer now to start coordinating the return of your car otherwise it's going to be 2 weeks, and another "2 weeks"

Hi,

i think it's pretty easy. If you didn't get the car in perfect running condition and also the money back until 31.08.2014 consult a lawyer. I hope you a written order with a detailed scope of services.

If you have a legal costs insurance, ask them if they take the costs for a lawyer consultation and maybe more.

This guy had so much time and really nothing happened - only excuses. No way to wait longer.

it's called FRAUD and yes you have legal avenues to pursue that could, at your request include cost of legal fees, "lean" on his company business, and other recommendations from your lawyer. You have lots of written documentation of him not fulfilling his obligation and promises from the "forum".

may try this are have a local xf owner go ck car. take photo"s pickup car if possible put in storage until you can pick it up are have shipped; May have to take legal action to get monies back and collect damages . Get a pi to check it out for you.

DJ - I really feel for you, and as you stated, he obviously does not get it.

DJ, I have no knowledge of the laws in that state regarding his failure to deliver. Law enforcement would only act on a court order though. So, unfortunately for you, you will have to consult a local lawyer close to his address and jurisdiction. The money may not be recoverable, as he has done work on the car, whether good or bad. On another note, I keep reading between the lines that something physical to him has happened, and he hasn't been able to work, resulting in his business failing. Am I reading this right? It would explain a lot, but still no excuse for his actions to all those involved. He should have been up front with everyone. If it were closer to me, I would be glad to look into it for you. Maybe someone close to his shop could at least drop by and take a look. Good luck...but, get ready for legal advise. Hopefully you have something in writing. A hand shake won't cut it in the legal world.

Sorry for not updating guys. Still no car. Still receiving promises of the car getting done soon. Here's the latest email from Cork.

The weekend and week went well with respect to the XF.

The compressor inlet, air filter and by-pass valve assembly got cranked
out. I've a couple welds to finish in the
By-pass tubing, but that comes easy.

A couple more heatshields to build and a few tubes to finish weld and
i'll have the construction done.

Oil lines and water lines still have a few loose ends, also, but not much.

At this point I don't know what to do except wait it out. Unbelievable that this has carried on for 2 years and 9 months.

Good luck DJ, I'll keep my fingers crossed for you, however I must say I didn't see any mention of the tune required in his posts.
Could be some serious A/F issues if it's not spot-on.
I'd recommend a Dash-Daq with some logging over the entire temp / rpm range before you accept it back from him.

His reply when I asked about the tuning:

No sir, I don't think tuning will be a problem. We have two options in my view; the rising rate regulator and a reflash of the ECU.

The RRR is my product and it is easy to tune, works consistently and is probably the most popular device ever for adding fuel when under boost.

A German car tuner in Katy, Texas, 170 miles east of here, appears fairly well known for tuning in boost applications. He can program ignition timing, whereas the regulator cannot. I have a friend that operates a Mercedes supercharging biz in Colorado Springs, and he tells me the RRR works perfectly, plus the stock MB knock sensor can easily handle the igniting timing.

I lean toward the reflash, as it is more reliable. Yet it is clearly less easy to change.

Your opinion?

DJ, if you have someone close by that would drop by the shop and take a look see, I think that would be fair, unless he is sending you photos of the mock ups. You don't want him extending this out any further, or a court will ask, why did you wait so long? I would document everything from now on if you haven't been....good luck bud....

Sorry to just come in here as I don't know the whole story and probably haven't even been actively reading on the forum for the time this has went on but why would a guy keep a car in his repair shop for 2.5 years? What is Corky's motives for all this? It sounds insane for someone to handle business in such a manner (unless he's a con or schizophrenic).

Where is this shop and what has he told you over the phone since you told him you want your car back immediately?
