Keep in mind that the legislation only applies if the President declares a state of emergency. The bill doesn't apply at all to your local retailer trying to sell his product for a few cents more than the guy down the street. Let's say there's a hurricane and supplies are interrupted and Joe's Gas Hole raises prices from $3.50 to $5.00 a gallon on the existing fuel in his tanks he has already paid for. This could be considered gouging under the legislation. But the prices we are experiencing today don't warrant any consideration as gouging. Besides, some states already have their own gouging laws so any federal law isn't going to impact those states much.
A better solution would be to get the corn out of the fuel. We'd save quite a bit per gallon, would see no net harm to the environment (when all aspects of ethanol production and energy output are considered), and meat, eggs, poultry, and even Coca Cola would be cheaper.
