I shot him a private message asking for advice. I really dont want this to be reduced to me having to sue the girl that hit me. I'm not sure I have the "self preservation instinct" to go through with that. She has a disabled son to deal with, so she doesn't need a court telling her she owes some guy $8000 on top of her own troubles from the wreck, etc. Then everybody loses, cuz even if she found a way to come up with the money, I pay a good portion of the money to lawyers for legal fees, and then I'm still upside down on the car.

In my opinion, she did her part by owning up to the fault in the accident...and she will be paying back the money her insurance company gives me through increased premiums...the insurance company needs to pay me the money here, and recoup it from her over time.
