There's no easy way to determine if a car is using the factory mapping or the kind of modified ECU map you'd be looking at. Even for a tuner staring at the paramters on a laptop, it takes a fair amount of experience to distinguish the factory map from a tuned ECU.
I agree - It would take to much work and most techs are going to follow the warranty book - if the repair book says re-flash; they just re-flash and you'll need to send your ECU back again.

It depends on your dealer - the service manager where I take my SRT in knows all of my mods and has no problems with bolt on mods.

Engine internals (cams, pistons) are another issue. He showed me the dealer installed CAI and header options that they offer for the new SRT8/10. I even remember them trying to sell me factory MOPAR headers and 3" exhaust upgrade when I purchased my new Dakota back in 95'

The biggest issue is racing. If Chrysler finds you've been to the track with your car... The warranty book even states that racing voids the warranty. Not sure when you show up at the track if they record your VIN or Plate #...
