It's been said that the SRT-6 accelerates faster than the folding spoiler can deploy to a safe level. In other words, the car would already be doing 80+ before the spolier would even be completing the cycle.
Probably not a HUGE time-gap, but enough that the engineers erred on the side of caution and created a fixed one.
Plus, HDDP did tests and confirmed that while the retractable spoiler created ~100# of downforce @ a given speed, the SRT spoiler generated 400# @ same speed. Can't remember what the speed was, otherwise I'd post it but I don't want to mis-quote info.
So yes, there is a function governing the form.
