was that a trial with a jury verdict, or was it your carrier settling? personally, if it was my carrier settling I would have told them that they need to be very careful here, because they are NOT representing my best interests by settling, based on the above facts, and in that case that brings the issue of bad faith. Unless of course they still wanted to do it and made sure that my premiums were not increased. if the car was stopped, and the kid ran into it,then I think Crumpy would have a case for mental distress over that poor child, and the anguish he caused her.
