I'd say for anyone closing in on the 45-day period, go ahead and open a Dispute.
It then gives you 20 days to resolve the matter with the seller before you have to either escalate it to a Claim or cancel the Dispute. That 20 days should be more than enough to get them repainted.
(I still have 17 days before my 45 days is up)
