Inform the seller you would have never bought a copy of the software if you realized it was illegally copied. Mention copyright infringement and he will probably give you your money back and tell you to keep the CD. A similar thing happened to me over some music CDs off eBay. The seller didn't disclose it was copied in the listing. He promptly refunded my money.

You don't make an ad stating "Item Condition: New" and "Condition: New: A brand-new, unused, unopened, undamaged item in its original packaging (where packaging is applicable). Packaging should be the same as what is found in a retail store, unless the item was packaged by the manufacturer in non-retail packaging, such as an unprinted box or plastic bag. See the seller's listing for full details." To me, a new burned CD disc is simply that, a new OEM disc. What's not stated is that he just burned the OEM CD an is selling home made copies, where's that in the fine print? And if he's stating New condition, why would he write "One used CD disc" on the package?

There is no buyers remorse, only priniciple and fraud.
