Really this issue should be up to the mechanic that pulled the engine. If it was running before he took it out, it sure as heck ought to run after he put it back in. Curious - how many hours labor did he bill for?
Only caveat to the above is if you ran the thing out of oil after you busted the pan and damage to engine existed before it was pulled. Even then, the mechanic should have determined if the motor would turn over. Heck - he should have taken a peak at the bearings while the engine was out and the pan was off
