Your local dealer can Be done in small claims court without much cost or difficulty. A much shorter process from beginning to end.
I seriously doubt it's the XF throttle by wire system, I own a standard transmission XF, and never have these problems. No other XF owners who have standard trannys have experienced this that I've heard of.
I think it's only the Automatics.
