Maybe they did not drain all the old oil out before they put the 8.5 quarts in. But an easy check is to verify with the dipstick.....if the dipstick does not show too much oil then the sending unit(?) might be no good. In that case you can ignore it until the next dealer visit or have them check it out when you have time if it bothers you that much, assuming it is still under warranty.
