I dont know about you Law in the states but UK law says for what ever it is your buying ' it has to be fit for the purpose it was intended for'. Jumping out of gear would mean its not fit, simple as that.
They have to change the whole car or you get your money back!

Just curious, does it make a difference if you keep hold of the gear stick until you shift to 2nd?
