Alrighty yall, I figured it out! Upon closer inspection, I noticed that my driver's side door was missing the door jam sensor, using an endoscope, I found that it had fallen in and was able to pull it out. Essentially the car thought the door was always open, making it beep whenever the car was in the ACC mode. Holding the button down, the beeping goes away in ACC. Problem fixed, thank you zip439, pizzaguy, and ala_xfire.

next step clockwise is ON/RUN - fuel pump runs for about 4 seconds, then constantly once engine is running.
next step clockwise is the spring loaded START, you do not need to hold the key there.

It seems to me this came up before, I can't remember what the cause/cure were. Perhaps as I drive around to day it will come to me, but I know this has come up before.

Try pulling the negative battery cable off for a minute or so. It may reset what ever is giving the alarm. If the alarm comes back scan the car for codes with something that gets into the Mercedes part of the car not your generic OBD II.
