Default Brand New Cup Holder might be broken

Purchased a new cup holder because my current one won't stay down. I have not installed the new cup holder yet, but noticed it is not staying down. Does anyone know if this is normal? Do I have to first install it for it to stay down?

No, it should work sitting in your hand. A friend gave me one( Billto) ! Reminds me , I should email him.... Push down, click, it stays..push again, click, it comes up.
