Those are possibilities, but if his also continuously tries to go down even when it's fully retracted like he said it did (after I told him my story), I would put my money on the spoiler motor (sensor). If that isn't the case, it could be a speed sensor. I know if the BAS/ESP (maybe it's the BCM, I don't really remember) system detects any difference in speeds for an extended period of time, it will deploy the spoiler.
