A very similar thing happened to Deb Walker... Her car was totaled. She fought the insurance company and now has a new car, new battery, new tires and even flew up to Michigan and drove back... all paid for by the offender's insurance. (Not to mention the medical costs the insurance will end up paying.)
Fight the bastards - sue them if needed.
