False advertising in a binding contract

Default False advertising in a binding contract

I hope everyone had an enjoyable weekend. Just to give everyone a laugh I put that winning bid on that SRT 6 marked as a limited on ebay and made the deposit. I had already ran the VIN and the vin was in fact a SRT 6. Well I contacted them to let them (by e-mail) know that the reason I put the bid in was because the pictures they showed and the vin they listed in the auction was a SRT 6. The dealer called me today and said it was a mistake that the car was a limited. Now I have the dealer back steppin and he said that the car was not a SRT 6 that they will show me the pictures of the limited to see if I wanted it. If I did not want it they would refund my deposit. Some times it nice to make the dealership squirm.

And I may check to see if I have legal ground to stand on.

I remember a very similar situation with a BMW M3 i believe.... someone back me up. Was over a 100 page read, even think there was a cliff notes version. Bottom line if they had the SRT6 on the lot that they were pulling the VIN from as well as pictures from for the auction I may go all out, if it was an honest mistake I will let you be the judge.

I completely agree... if they have an SRT on the lot that matches the VIN they posted then I would seek it out to the fullest extent. I would check quickly to make sure they don't sell it to someone else quickly.

Half of me says they didn't get the price they were looking for on the SRT so they don't want to sell it to you, and the other half says honest mistake.

If they are being underhanded I would pursue it to the fullest.
