Default question about working under the table

A little over a month ago I was working for my ex girlfriends father at a tile store under the table. Being an ex girlfriend I obviously am not working with him anymore. So he decided he wasn't going to pay me for the last 42 hours that I worked. When I finally got ahold of him he said to email him my hours. I resent the email 3 times and texted/ called him several times and apparently he went back to ignoring me. At my age its tough to call almost $500 a loss, especially from someone with enough money that he wouldn't even see it missing but what can I do? Being that its under the table there's no record of me working for him. Will contacting the better business bureau or local police do anything?

text him that you are going to turn him into the irs for paying employees under the table, if he does not send you you money and that you have contacted a lawyer,(do so) the fine to you may only be up to 5,000.00 but to him it could be up to 1,000000.00

Look around and get a lawyer that will work on consignment, have him write a simple lettter, that usually breaks the ice, works for me. He does the collection.

Other than that, go to the court house and addresss your conserns to the justice of the peace or the clerk of the court, they will advise you as to the legal proceedings. Take documentation to either of my suggestions and let them assist you.

The local news is always looking for christmas stories and you can have yours put out there, though you likely not get money. Could get a better job offer.

Obviously this kind of labor is frowned on, just tell him that you will take it further with the authorities. if he has any sense he'll pay up.

I'd take his company name out of of your post though.

If he found you under the table with his daughter though, it may be a long fight.

Try the Dept of Labor they should help. Also does he have any illegals working for him. Tell him your calling immigration.

IRS certainly is a good threat. There should be a Bureau of Labor in your state. They handle labor issue complaints. Don't do a lot of threatening, that just sounds childish. Just email him, tell him, to pay what is owed to you, or you will report him to the above mentioned agencies. If they don't do anything, then small claims court. A judge will see right thru the guy. That way you arent' out a lot of money using a lawyer, who won't really even look at case for $500... That's beer money to them...good luck... The police will tell you it is a civil matter, which it is...not their jurisdiction...

I would also be careful of what you put in writing to him. This guy may try to turn this around on you by saying that you are trying to extort money from him with these threats of going to the authorities by making up a story about working for him and not getting paid.

My lawyer takes 30% and I have hit up people that have tried to get out of 75$. Find a good lawyer and then keep on their good side. I got a drunk to replace my 300# mail box that was full of rebar and such, cost him $1800 in addition to the dui and court costs. Woody

You can always report ur income and file taxes in April. Then u wd be off the hook and he would be on it.

Contact the secretary of State's Office.

You have nothing to fear here as it is under $600. A private contract he did not need to report either.

But the unfair labor practice is frowned upon. Most States have a unit that will deal with this. Do not threaten to go, that resembles extortion. Just go.

No lawyer required.

Sorry for your loss, But you were both doing something illegal to evade the IRS taxes. Be careful what you do because the IRS could come after you to collect back taxes from previous payments. The last thing you want is the headache of an IRS audit of your bank account(s). The headaches are not worth the $500 which you aren't likely to collect anyway. You're ex's father probably knows this and feels comfortable about not paying you.

Almost every state has a simple process for filing a Small Claims Action. Forget IRS, they don't have the time, forget the cops, it's not a criminal matter, and forget the lawyer, he'll only advise you to file a Small Claims Action.

Unless you know the business' Employer Identification Number (EIN), it might be hard to do anything to him via the IRS. More than a few stories on budget cuts there.

State bureau of labor might be better if you want to go the unpaid employee route. Slow and they're facing budget cuts in most states too.

Federal Bureau of Labor primarily gets involved in contractor vs. employee classification disputes. IRS will send you Form SS-8. You would send the completed form to BOL. Takes them 6-18 months

If you're just willing to call yourself an unpaid subcontractor, small claims court could be the quickest route.
