I would have to be in agreeance with some people who posted early in this thread. I would limit your affiliation with it, and in fact, refrain from further posts in the thread relating to the issue. The thread has significantly devolved into derogatory exclaimations. This would not look good if any court proceedings transpired.

Read everything with a fine tooth comb, don't do anything you don't feel comfortable with, and good luck with all of it.

I second that. I am pretty sure that in most jurisdictions the punishment for a DUI convicton is pretty darned severe by itself. As for compensation, the insurance gets the car and your med taken care of. Just don't forget that you don't need to take their offer of settlement. It's your car, your health. Decide what you need to be made whole and stick to that. You also get compensation for rent-a-car (and you don't have to take a Geo no matter what they say), time off from work to go to the doctor, all medical expenses, and it sounds corny but you are entitled to "pain and suffering".

If you have long term pain you can be compensated. This gets abused but if you really are in pain the insurance company will compensate you, with doctor visits etc.

If by some strange chance they decide to fix your car, all the parts that are taken off are YOURS. Don't let the body shop tell you different. That's your car. Ask for ALL the parts back. I was told that I was not getting back a $500 wheel because it had a barely visible scratch on it and they were returning it for the "core charge". I called the parts department and found out the $500 charge they put down to get a reconditioned wheel was equal to the cost of a new wheel. It was a bogus claim. The body shop was going to flip the wheel or somebody there was going to take it home.

I took other parts too, things that aren't sold separately but can be used to fix minor damage. They missed damage that I had to point out and insist be fixed. Things that were non-stock that they didn't initially include in the repair estimate. You have to be a firm advocate for your personal interests.

The insurance company wants to get in and out for the lowest cost. They tend NOT to tell you what you're entitled to. They tend to "steer" you to what they want you to do even when you are entitled to other options that might be in your best interests. For example you do NOT have to take aftermarket, 3rd-party replacement parts. They will sometimes try to steer you in that direction by defaulting that choice on the repair work order that you will sign. Read that paper carefully and make sure you both understand and agree to all terms. If it's not written down, it's not going to happen - even if the shop tells you they'll "take care of it later".

All in all, the consumer today is at a distinct disadvantage when dealing with insurance companies. The average consumer doesn't know what their policy covers, what is, and what is NOT up to the insurance company.

If the accident is not your fault and the other party is insured, you do not have to spend a nickel to make things right. No towing bills No rent-a-car bills. No deductible (that only applys to the other person). No co-pays or other medical fees. No uncompensated time off from work. No living with injury that came from the accident.

But you can't lie, cheat, or be rude, mean, or deceptive. Stick to the truth, know your rights, and don't take no for an answer if you know that you are entitled. Stay away from the other person. Don't talk to them. Don't talk to their insurance company without your lawyer or at the VERY least, another person. Write down your most simple account of what happened, and stick to that truth. Don't answer questions about "What did you think when...?" Or "Did you notice...?" Or "Was it your fault at all that...?" Stick with something like what youo wrote at the beginning of the thread. "I was just sitting there at a full stop and I was hit from behind and pushed forward into the car in front of me. Speed at impact zero. End of story.

Thank you everyone for the advice..i wished i had read it BEFORE i talked to her insurance company though lol..but they didnt ask any questions, only a basic story aabout what happened. We cant proceed any further until her insurance company does one of the following..

A. Talks to the drunk driver. (Shes in jail and theyve been unable to reach her)
B. Talks to the other lady involved in the accident that was infront of me.(cant contact we dont know her name)
C. Gets the police report (5-30 day wait..? that kinda pissed me off)
D. We go down and get the policee report and fax it to them. (like $3 a page lol. Roads are too bad to drive all the way into tulsa though..)

So i guess ive reached a dead end for now.

But thank you everyone for the advice..i didnt know almost everything u guys have said to me i appreciate the help and advice.

Really glad you had no major injuries, it sounds like it was pretty scary.
In Minnesota I would be liable for the damage to the car ahead of me even though I was shoved by another car. I think that should be conditional, there isn't enough road for every car to stop 15 feet from the car ahead of them, traffic flow would be rediculously slow.

Well, I've got to chime in too. There are two reasons to consult a lawyer and keep your mouth shut. You may have something wrong with you and it hasn't shown up yet, and insurance companies get a whole lot happier about settling property damage claims in a generous manner when you have a potential bodily injury claim that you're willing to forget. The lawyer, of course doesn't care anything about your car. He/she just wants to make a quick buck on the P.I.(personal injury) claim without going to court. All this of course depends who had insurance and what coverages are in play.

If you have full coverage it is your' collision' coverage that fixes your car. If you only have liability it is 'uninsured motorist property damage coverage' that covers your loss. Don't get this coverage mixed up with 'uninsured motorist bodily injury coverage'. U.M.P.D. and U.M.B.I. is optional you may or may not have it but with a nice car like you have I would hope you have full coverage.

Unless there is a potential for some bodily injury money a lawyer will charge you, but most P.I. lawyers will give you a free consultation.

I've never sued anyone and I've had ample opportunities. So no one should construe what I wrote as pro law suit. I just know some insurance policies have a "we don't pay claims clause" lol and you have to watch your back.

Oh no, i didnt hit the car infront of me lol, she hit my rear somewhat at an angle and tossed me into the next lane like i was a rag doll then plowwed into the car that WAS infront of me lol..so basicaly the SUV made its way in between me and the car infront of me by shoving me to the side and cutting in line lol

Being stuck in doors with limited movement has left me with an odd sense of humor..i think the crazyness is setting in >.< lol.

Update on the situation.

Yesterday I went in and got an MRI done on my neck, lower back, and upper back, waiting results for those.

The doctors put me in home bound for six weeks, which means i dont go to class anymore, they send the work to me.

And i start physical therapy Thursday.

And Ive been out of work since the accident happened..im glad its tax time, those income taxes r the only thing that will keep me alive for the next few weeks lol

Alot of this seems a bit unnecessary..but im not argueing..theyre doctors i guess they know what theyre doing..as for the crossfire..

WITHOUT taking anything apart to asess the damages further it came up to a little over $12,900 in damages, theyre taking everything apart over the next couple days and seeing what more was damages, on the sheet of paper with the current known damages in big bold letters at the end it says "MORE DAMAGES WILL BE FOUND" lol..so..KBB value on the car ('04 graphite with a little over 19k miles) was i think just under $15,000..so..im assuming its more than likely totaled..and if not..idk if i even want the car back lol

And somehow, dont ask me, but the battery, which is just slightly over a month old, is completely useless now...their was NO damage whatsoever to the part of the car the battery was on..none even near it, all the damage was on the front end(destroyed the radiator lol), left side of the car, and rear fender..so idk how the battery was rendered useless..

Most likely, the battery pos cable shorted to the frame. Possibly at the starter motor if the engine was pushed back or to one side.

Sudden depletion, shorted it out.

Probably shorted your ECU and other management systems as well.

When you can walk again., walk away from that car.

Quickly.

It sounds like the vehicle will be a total loss.

Listen to the doctors and keep track of your expenses... Do it in writing with receipts... Don't wait until later - you will never remember everything...

You're pretty close to being in a position to get a new one with little or no out-of-pocket.

That's horrible what is happening to you, but it's great that you are taking the tests to determine what injuries you may have sustained..I had told you about my friend that was hit and settled too soon..she is now under chiropractic care .. What has worked for her is a chiropractor that uses an ACTIVATOR it looks like a hypodermic but uses pressure to adjust your spine and it makes all the difference for her pain management..If she stupidly doesnt shovel snow she only goes once a month for a tune up..and that costs $30 per with insurance co pay.. Hope you have good insurance, the test costs are enormous. Is the drunk driver still in jail or have they released her to do her damage again.. So Sick!! I'm all for having fun but I know not to drive if I drink,,and having a Crossfire has put a bull's eye on my back, I've been stopped by police twice just for them to ask me what kind of car it was..Isnt that illegal for them to do that?? But then I am blond and in a crossfire,, what a combination..
