when reach 90 km speed it opens and when slowing down it remains open. even if stopped. pressing the switch does not help.

That would be my first reaction as well.
Probably should take it to a dealer and let them "test the battery", that will cost around $100 for them to tell you the battery is OK.
THEN, in a few days, take it back to them so they can test the battery again, and charge you another $100 to tell you they can't find anything wrong.
THEN, in a few days, spend $125 on a new battery, if it fixes it, fine. If not, you go from there.
But NEVER skip paying a dealer at least TWICE for nothing.
OR, you could just replace the battery and go from there. (If your battery is over 48 months old, it's time for a new one anyway - if you love your SKREEM, seatbelt module and car in general.)

any time when the car reaches 90 kph. so even if slow down and even stop, the spoiler remains open.
the only way to close it is by pressing the bottom of the switch and wait until it stops, then turning off the switch.
i was suggested to remove the fuse so at least it is not deployed but then i need to know which fuse it is and where is located.

Fuse 20 in the undershood fuse box was the powered spoiler fuse in 2005, I believe.
But that fuse differed from year to year and between Base/Limited. You can try 20, but I'd consult the card on the underside of the fuse box lid, it will tell you which one it is.
But keep in mind that ignoring this little symptom isn't really a good idea. The cause can be many things, and in some cases, the car's operation will eventually suffer due to what is going on.

- The spoiler acting odd is often a sign of a degrading battery.
- It can also be a sign of a dying alternator.
- An issue with the wheel speed sensors can cause this.
- In such cases, cruise control will not work or will act oddly.
- A deteriorating ground between chassis and engine block will cause odd troubles.

- It can be that the BCM is just confused.
- Try this:
- Shut engine off.
- Turn headlights on.
- Raise hood, disconnect battery.
- Wait 20 seconds or so.
- Reconnect battery.

- You can also take the car to a dealer; this won't get the issue fixed, but it will cost you a lot of money and in some cases, you will get the car back with additional problems.

What did you try? The Reset? The battery ground fix?
Keep in eye on the car, my bet is that other symptoms will arise soon, try to remember that any new issues MAY or MAY NOT be related to the spoiler having a mind of it's own.
Example: If you start to observe odd behavior when trying to start the car....

- i hope that if i remove the fuse it will remain down...and nothing else goes weird!
- and if so, then hope putting it back things with get back to where they were!

Could be a bad traction control relay in the relay control module.
Open the RCM (see video on YouTube), turn the key to the ON position.
2 of the 3 middle relays should remain closed (engaged).
If not, bad relay.
To verify - Manually close the relay, turn the key to the ON position and see if you can lower the wing.
